Terms of Use

1. Nature of the service

HypoxiaLiveVenom is a training and performance-analysis tool. It is not a medical diagnostic, treatment or emergency product. If adverse symptoms occur, stop the protocol and seek professional assistance.

2. Permitted use

You receive a personal, limited, revocable, non-exclusive and non-transferable licence to use the authorised version. Professional accounts may access only athletes under their responsibility and with current authorisation.

3. Devices and accuracy

Continuity and accuracy depend on the iPhone, Apple Watch, sensors, placement, movement, permissions and third-party services. Correlations support human decisions and do not establish causality.

4. Intellectual property

The software, code, architecture, trade name, visual identity, text, graphics, report structure, selection and arrangement of metrics, documentation and materials belong to their owner or are used under licence. Except where mandatory law permits otherwise, copying, adaptation, resale, sublicensing, systematic extraction, decompilation, reverse engineering, reconstruction of algorithms, distribution of screenshots for competitive purposes and creation of derivative products from confidential materials are prohibited.

5. Confidentiality

Beta builds, unreleased functions, technical documentation, analytical criteria, issues and directly supplied materials are confidential. They must not be shared with competitors or published without written authorisation.

6. User data

Users retain their rights in their personal data. Any technical licence required to process those data is limited to providing the functions and purposes to which they have consented.

7. Availability

The beta may experience interruptions, changes and removal of functions. A beta invitation does not guarantee future commercial access or continued free use.

8. Suspension

Access may be revoked when the test ends or because of security risk, unauthorised use, breach of confidentiality or breach of these terms.

9. Governing rules

Mandatory rules in the user’s place of residence apply and, otherwise, the law applicable to the controller. Nothing limits non-waivable consumer or data-protection rights.

Language

This English version is provided for accessibility. If an interpretation differs, the Spanish version prevails, without limiting mandatory rights under applicable law.
